Frequently Asked Questions

No matter what your source of income is, we've got you covered. There's a plan for everybody!

Which ITR form should NRIs use for business income in India?⌄

NRIs should use ITR-3. It covers business or professional income and also lets you report rent, capital gains, and interest in the same return.

Can an NRI file ITR-4 Sugam?⌄

No. ITR-4 is only for residents who opt for presumptive taxation. NRIs cannot use it, and a return filed on the wrong form can be treated as defective.

Can NRIs use presumptive taxation under Section 44AD or 44ADA?⌄

No. These schemes are only for resident taxpayers. NRIs must maintain books of accounts and show actual profit in ITR-3.

Is a tax audit compulsory for an NRI with business income?⌄

Only if you cross the limits. A tax audit is needed if business turnover is above ₹1 crore (₹10 crore with limited cash), or professional receipts are above ₹50 lakh (₹75 lakh with limited cash).

Do I need to file an Indian return if my business is outside India?⌄

Not for that business income, as it is not taxable in India. But you must file if you have other taxable Indian income, such as rent or capital gains, or if you want to claim a TDS refund.
